I’ve come across a number of guidelines for copyright protection in the US/UK, but little for Canada…. if you have any resources to share or perhaps a blog post about this one day, I’d be very interested. (In addition to the situation of your images being used outside of Canada….whose copyright law do you follow, and what would you do if a licensee went outside of the terms of an agreement with your images (and they are based in another country)? Theorectically under the objective theory of contracts and business law, rights and copyrights law is the doctrine of unjust enrichment. one may successfully repudiate damages either compenastory, nominal, incidental, punative and consequential
as the originator of literary or artistic publications in tangible form that is subject to the life of the author plus seventy years and publishers 95 years after the inital date of publication and 120 years after creation of the intellectual property. Whereas one party at the expense of another should not be allowed to profit or enrich themselves inequitably at the expense of others, provided by the following: 1) the party has conferred a benefit on the other party 2) The party conferred the benefit with the reasonable expectation of being being paid 3) The party did not act as volunteer in conferring the benefit 4) The party receiving the benefit would be unjustly enriched by retaining the benefit without being paid for it.
National congressional act Digital Millennium Copyright Act 1998 provides for additional protections of digital information and penalties with the exception of noncommerical, electonic mediums for example most interesting Section 102 exclusions mathamatical calculations.
Great article, I still have queries about how copyright works on such things as taking photos at car shows and then manipulating the photo of the cars or parts of the cars with filters etc. Can you be breaching copyright of the car owner or manufacturers for displaying partial issues of the car logo’s like Cadillac or Ford etc. and making prints or cards or posters etc. for sale. If you take shots of the head or tail lights or chrome work etc….
Hard to know what is allowed and seems hard to find any exact rulings anywhere.
